1. Acceptance of Terms

By accessing or using DrivePilot ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

DrivePilot is a cloud-based SaaS platform for driving schools, providing scheduling, student management, invoicing, and analytics. The Service is provided on a subscription basis and hosted in the European Union.

3. Account Registration

You must provide accurate, current and complete information at registration
You are responsible for maintaining the security of your credentials
You must notify us immediately of any suspected unauthorised access
You must be at least 18 years old or hold legal authority to accept these Terms on behalf of a business

4. Subscription and Payment

DrivePilot offers Starter, Growth and Enterprise subscription plans. Current prices are displayed on the website and may change with 30 days' notice.

Billing: subscriptions are billed monthly in advance; payment is due at the start of each billing period
Late payment: service may be suspended after 7 days of overdue payment
Refund policy: 14-day money-back guarantee for first-time subscribers; no refunds after 14 days; unused subscription days are not refunded

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt unauthorised access to our systems or data
Upload malicious code, viruses or malware
Reverse-engineer, decompile or disassemble the Service
Resell or sublicense access without written authorisation
Spam, harass or abuse other users of the platform

Violation may result in immediate account suspension without refund.

6. Data and Privacy

You retain ownership of all data you input into DrivePilot
We process your data only to deliver the Service, as described in our Privacy Policy
You may export your data at any time in CSV or JSON format
On termination we will delete or anonymise your data within 30 days, except where retention is required by law

7. Service Availability

Uptime target: 99.5% (excluding scheduled maintenance)
Scheduled maintenance is communicated at least 48 hours in advance
We do not guarantee uninterrupted or error-free service
You are responsible for maintaining your own backups of business-critical data

8. Intellectual Property

DrivePilot and all original content, features and functionality are the property of DrivePilot and protected by applicable intellectual property law. You may not copy, modify, distribute, or create derivative works without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DrivePilot is not liable for:

Indirect, incidental, special or consequential damages
Loss of profits, revenue, data or business opportunities
Service interruptions or data loss
Errors or inaccuracies in the Service

Our total aggregate liability shall not exceed the fees you paid in the 12 months preceding the claim.

10. Termination

By you: cancel at any time from account settings; cancellation takes effect at end of current billing period
By us: we may suspend or terminate immediately for ToS violation, 30+ days overdue payment, or legal obligation; service discontinuation is communicated with 90 days' notice
Effect: access is revoked immediately; you have 30 days to export your data; no refund is issued for the remaining subscription period

11. Governing Law

Governing law: Laws of Luxembourg
Jurisdiction: Courts of Luxembourg
Dispute resolution: we encourage resolving disputes amicably before litigation

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-platform notification at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance.
